These Terms and Conditions of Sale (hereinafter referred to as "Terms") define the rights and obligations of the parties in connection with the use of services offered by the website convfast.com (hereinafter "the Site"), operated by MotDiese, a simplified joint-stock company (SAS), registered with the Paris Trade and Companies Register under number 803 625 516 R.C.S. Paris, with its registered office at 12 rue Vivienne, 75002 Paris, France (hereinafter referred to as "the Company"). These Terms apply to any natural or legal person (hereinafter "the User" or "the Customer") accessing the Site or subscribing to its services, whether free or paid.
By accessing the Site or subscribing to any of its services, the User acknowledges having read these Terms, fully understood them, and accepts them without reservation. Any deviation from these Terms must be subject to prior written agreement between the parties.
The purpose of these Terms is to govern the conditions under which the Company provides the User with online services for converting, merging, compressing, signing, and managing PDF files (hereinafter "the Services"). They define the terms of access, use, payment, as well as the respective rights and obligations of the parties.
These Terms apply to all Services offered on the Site, whether accessible free of charge or via a paid subscription. They also apply to any order placed by the User, whether for a trial period or a long-term subscription.
The User accepts these Terms upon accessing the Services or making a payment. This acceptance is evidenced by checking a box during registration or by confirming the order. Any use of the Services following an update to the Terms constitutes acceptance of the new conditions.
To access the Services, the User must be a natural person at least 18 years of age with legal capacity, or a legal entity duly represented by an authorized person. The User agrees not to use the Services for illegal purposes or purposes contrary to public morality.
Access to the Services requires the creation of a personal account. The User must provide accurate, complete, and up-to-date information (name, email address, etc.). Any false statement or intentional omission may result in immediate suspension or deletion of the account, without notice or refund.
The User receives strictly personal and confidential credentials (email address and password). They are solely responsible for their safekeeping and use. In case of loss, theft, or unauthorized use of credentials, the User must inform the Company immediately by email at support@convfast.com. The Company reserves the right to temporarily suspend access to the account in case of suspected fraud or abnormal activity.
The Services are intended for strictly personal and non-transferable use. Any attempt to resell, share, pool, or commercially exploit the Services is strictly prohibited and will result in immediate termination of the account, without prejudice to any legal proceedings.
The Company offers a 48-hour trial period at the rate of €0.50 including VAT, allowing the User unrestricted access to all features of the Services. This offer is limited to one use per person or entity.
Upon expiration of the trial period, unless expressly cancelled by the User, the subscription is automatically converted to a monthly plan at the rate of €39.90 including VAT. This amount is charged monthly on the anniversary date of the subscription, unless cancelled before that date via the User's dashboard.
Payments are made via the secure Stripe platform. The Company does not store any banking data on its servers. Transactions are secured by HTTPS protocol with SSL/TLS encryption. The User authorizes the Company to automatically charge the amounts due to the registered payment method.
In case of payment failure (insufficient funds, opposition, etc.), access to the Services will be suspended until regularization. The Company reserves the right to pursue recovery of amounts due, plus management fees and legal interest.
An electronic invoice is made available to the User in their personal space after each payment. Upon express request, a paper invoice may be sent, subject to additional fees.
In accordance with Articles L.221-18 and following of the French Consumer Code, the User has a period of 14 calendar days from subscription to exercise their right of withdrawal, without having to justify a reason or incur penalties, except in the cases provided below.
The right of withdrawal does not apply if the User has used the Services during the withdrawal period (e.g., file processing, access to premium space). By accepting these Terms, the User expressly acknowledges waiving their right of withdrawal in case of immediate execution of the Services.
To exercise their right of withdrawal, the User must send a written request to support@convfast.com, specifying their contact details and the subscription date. An acknowledgment of receipt will be sent within 48 hours. If eligible, the refund will be made within 10 business days via the original payment method.
The Services include, but are not limited to: converting files to PDF, merging multiple PDFs, compressing files, electronic signature, as well as advanced management tools. Premium Users benefit from a 500 MB file size limit, priority processing, and a personalized dashboard.
The Company strives to ensure continuous availability of the Services but cannot be held responsible for interruptions due to maintenance, technical failures, or force majeure.
The User may cancel their subscription at any time via their dashboard. Cancellation takes effect at the end of the current billing cycle. No refund will be granted for the period already started.
The Company may suspend or terminate an account without notice in case of: (i) violation of these Terms, (ii) fraudulent or abusive use of the Services, (iii) non-payment of amounts due, or (iv) infringement of third-party rights. The User will be informed by email of the reasons for termination.
The Company shall not be held liable for direct or indirect damages (data loss, financial loss, etc.) resulting from the use of the Services, except in case of proven gross negligence or intentional fault. The User assumes full responsibility for files uploaded and processed via the Site.
The Company shall not be held liable for failure to perform its obligations due to a force majeure event as defined by Article 1218 of the French Civil Code (e.g., natural disaster, cyber attack, general breakdown).
All elements of the Site (texts, logos, scripts, interfaces, etc.) are the exclusive property of the Company or its partners. Any reproduction, modification, or distribution without prior written authorization constitutes infringement subject to criminal and civil prosecution.
In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act, personal data collected (name, email, etc.) is used exclusively for providing the Services. Files processed by the User are deleted from our servers immediately after processing, unless otherwise requested.
The User has the right to access, rectify, delete, and port their data. These rights may be exercised by sending a request to support@convfast.com, accompanied by proof of identity.
The Company reserves the right to modify these Terms at any time. Users will be notified by email and/or via a notification on the Site at least 30 days before the changes take effect. Continued use of the Services after this date constitutes acceptance of the new Terms.
These Terms are governed by French law.
In case of dispute, the parties agree to attempt amicable resolution before any legal action. Failing agreement within 30 days, the dispute will be submitted to the competent courts of Paris, unless otherwise provided by law.
